Identifies all retailers of tobacco products and conducts inspections, checks, surveys and surveillance at various sites/locations within the region to gauge compliance with applicable tobacco control legislation; issues warning letters, issues violation tickets and attends court to ensure compliance when education fails. - Conducts routine inspections of tobacco retailers to ensure conformance with applicable federal, provincial, and municipal regulations and standards. Conducts administrative and enforcement checks to ensure compliance with tobacco control legislation.
- Investigates and performs inspectional, regulatory and enforcement duties on tobacco control matters. Investigates complaints on a variety of matters; issues orders and recommendations as required; re-inspects and conducts surveys.
- Responds to public enquiries and complaints regarding regulations and health concerns pertaining to tobacco use. Works with other Health professionals in the delivery of tobacco control programs, initiatives and objectives.
- Issues warning notices and violation tickets to tobacco retailers for tobacco related offences; monitors retailers suspended from selling tobacco products.
- Help select, age test and train Minor Test Shoppers. Schedules times with Minor Test Shoppers to conduct administrative and enforcement checks.
- Compiles, assembles and analyzes data related to tobacco control and regulatory matters and makes recommendations on matters such as improved standards and controls for tobacco enforcement program enhancement and developments; reviews and drafts applicable by-laws, standards, guidelines and policies.
- Maintains daily log of all tobacco enforcement activities.
- Maintains a chain of custody for evidence that is collected for presentation in court.
- Prepares reports on investigational and inspectional work performed; obtains samples and specimens and other material; submits tobacco products for testing and analysis; interprets laboratory results; collects evidence of violations of by-laws and regulations.
- Submits reports to Crown Counsel for violation ticket disputes and appears as a witness in court prosecutions.
- Provides advice, assistance and information to a variety of contacts on tobacco control matters; interprets applicable regulations and by-laws to the public; participate on internal/external environmental health-related committees.
- Prepares and conducts lectures and workshops on tobacco control for groups such as students, public health inspectors, co-workers and business groups. Assists in the production of educational material related to tobacco control.
- Liaises and works collaboratively with Public Health Inspectors, Ministry of Health Services staff, Health Canada Tobacco Inspectors and other Health Authority TEOS on TSA and TA issues. Liaises with internal and external contacts on tobacco control matters.
- Keeps fully informed and current with all Tobacco Control legislation.
- Oversees and trains students assigned to Fraser Health for their required practicum.
- Performs other related duties as required.
Diploma in social sciences, education, policing or health-related field. Three years' recent experience in regulatory enforcement, or an equivalent combination of education, training and experience.
Must be eligible for designation by the Minister of Health Services as an enforcement officer pursuant to S.3(1) of the Tobacco and Vapour Products Control Act.
Valid B.C. Class V Driver's license and access to own vehicle.
Skills and Abilities
- Ability to analyze and interpret test and inspection results, and determine compliance or corrective action in the inspection of tobacco retailers.
- Knowledge of surveillance, investigative and complaint investigation techniques; ability to enforce acts/regulations and to issue violation under difficult/stressful conditions.
- Ability to communicate effectively verbally and in writing, including speaking in public and preparing reports.
- Ability to utilize discretion appropriately when enforcing regulations and interpreting guidelines.
- Ability to establish effective working relationships with others; to work independently under limited supervision and to organize/prioritize work.
- Ability to successfully defend violations in provincial court without the assistance of Crown Counsel.
- Ability to operate required equipment including related software applications.
- Physical ability to carry out the duties of the position.
