Summary of Functions

Reporting to the Senior Manager, Infrastructure and Regulations, this position is responsible for analyzing and coordinating the review of complex applications made pursuant to Ontario Regulation 160/06, including municipal infrastructure projects, based on policy and program interests. This position also reviews moderate to complex Environmental Assessment planning files. Further, this role leads CVC’s non-compliance resolution, enforcement and hearing/court processes, and related program activities.

Eligibility Requirements

Education

  • University degree in Geography, Planning, Environmental Science, Engineering, Enforcement or a related field
  • Provincial Offences Officer designation is required
  • Membership with the Ontario Professional Planners Institute (OPPI) and RPP designation is preferred

Experience

  • 7 years of experience related to major tasks
  • Advanced Provincial Offences Officer Training

Knowledge, Skills and Ability

  • Expert knowledge of the Conservation Authorities (CA) Act and associated Regulations, strong working knowledge of the Planning Act, and the Environmental Assessment Act
  • Strong working knowledge of other related provincial and federal environmental legislation, regulations, and protocols
  • Expert Knowledge and experience with CA hearing and Provincial Offences court processes, including preparation of briefs, presentations, exhibits, and providing expert evidence
  • Strong working knowledge and experience reading and interpreting construction plans and drawings – including environmental assessment studies
  • Broad experience conducting large-scale and complex construction site inspections and undertaking non-compliance and enforcement activities
  • Demonstrated ability in providing solution-oriented approach using advanced critical thinking, creativity, problem solving, facilitation and communication skills when coordinating and evaluating development related applications
  • Excellent teamwork and customer service skills, including the ability to work respectfully and inclusively with diverse stakeholders
  • Actively participate in a collaborative team environment, sharing technical knowledge and learning
  • Demonstrated excellence in written and verbal communication skills with an emphasis on customer service to explain rules and procedures clearly to all stakeholders

Summary of Major Tasks

Regulatory Review, Investigation of Violations and Infrastructure Planning

  • Lead and manage review of complex applications pursuant to O. Reg. 160/06 and municipal infrastructure projects, providing comments based on CVC policy and program interests, internal technical review and guidelines related to natural hazard and water management
  • Conduct site visits and inspections for permit applications – pre-consultation, enforcement and compliance
  • Issue permits pursuant to Ontario Regulation 160/06
  • Manage the review of moderate to complex files pursuant to the Environmental Assessment Act submitted by member municipalities and provide comments based on CVC policy and program interests, internal technical review, and Provincial policies related to natural hazards
  • Lead and manage investigations of non-compliance for permit and infrastructure development projects – including site visits and the collection of evidence, as necessary
  • Lead, coordinate and participate in CVC regulatory hearings, LPAT appeals, and court proceedings associated with the issuance, appeal (non-decision or denial) and non-compliance of Section 28 permits
  • Assist in the development of procedures to resolve non-compliance – including steps for enforcement and court proceedings

Supervision

  • Supervise Junior Regulations Officer
  • Provide direction and guidance on regulatory, compliance, enforcement, and development matters to planning and regulations program staff
  • Ensure consistency and quality in the implementation of policies and programs
  • Distribute and manage workload to junior regulations program staff
  • Train and mentor junior regulations and planning program staff

Policy and Program Management

  • Help lead the preparation of guidelines and stakeholder information bulletins as it relates to regulatory procedures, processes and partnerships
  • Assist in the formulation of regulatory policy through consultation, coordination, and negotiation with affected parties including internal and external stakeholders
  • Provide expert advice and review provincial regulation related initiatives and participate in meetings to provide recommendations as they relate to CVC’s regulatory interests
  • Participate in inter-agency regulatory committees/meetings to provide recommendations as they relate to CVC’s regulatory interests

Representation of CVC and CA Interests

  • Represent CVC’s interests at court, hearings, tribunals, boards and meetings where required to ensure CVC’s interests are appropriately identified and addressed
  • Foster and maintain effective client relations with member municipalities, regulatory agencies, consultants, and internal and external clients
  • Facilitate, mediate, and/or moderate and negotiate matters to build consensus and resolve conflicts internally and externally, as they pertain to regulatory and development matters
  • Coordinate and chair meetings (in office/on site) with both internal and external clients to facilitate the review and non-compliance resolution processes
  • Undertake site visits to review site characteristics and identify constraints – including to undertake enforcement and non-compliance activities based on CVC’s areas of interest

Management Support

  • Provide input and advice on overall program development
  • Provide advice and recommendations on internal and short term departmental functions and strategies related to CVC’s regulatory program
  • Attend Leadership Team meetings to share opportunities and provide input on supervisory matters
